1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Wayfinity Ltd, a company registered in Cyprus with its registered office at 77, Strovolos Center, Floor 4, Flat/Office 401, Strovolos 2018, Nicosia, Cyprus ("Company," "we," "us," or "our"), governing your use of the Rebirth mobile application ("App") and any related services. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the App and delete it from your device.

2. Eligibility

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you are at least 17 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of a minor between the ages of 17 and 18, you represent that you are the parent or legal guardian and accept these Terms on their behalf.

3. Account Registration and Security

To access certain features of the App, you may be required to create an account using Apple Sign In or email-based one-time passcode (OTP) authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

4. Description of Service

Rebirth is a personal development application that provides a structured 30-day behavioural challenge designed to help users build discipline and reduce reliance on dopamine-driven behaviours. The App includes daily task tracking, momentum scoring, progress analytics, journaling prompts, daily briefings, and challenge customisation features. The content and features provided within the App may change from time to time at our sole discretion.

5. Subscriptions and In-App Purchases

5.1 Subscription Plans. Rebirth offers the following auto-renewable subscription plans: Monthly (€22.99/month) and Yearly (€89.99/year). Promotional pricing (including discounted yearly plans) may be offered from time to time. All prices are inclusive of applicable taxes unless otherwise stated.

5.2 Payment Processing. All payments are processed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. We use RevenueCat, Inc. as our subscription management platform to manage entitlements, process webhooks from Apple, and track subscription status. RevenueCat processes your purchase receipt and subscription status data on our behalf.

5.3 Auto-Renewal. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

5.4 Managing Subscriptions. You can manage and cancel your subscription at any time through your Apple ID Account Settings (Settings → Apple ID → Subscriptions → Rebirth). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

5.5 Free Trials. If a free trial is offered, the specific duration will be disclosed before you are charged. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Free trials are available to new subscribers only.

5.6 Refunds. All purchases are processed by Apple and are subject to Apple's refund policies. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

6. User Content and Data

6.1 Your Content. You retain ownership of any content you create within the App, including journal entries, custom challenge configurations, and signature uploads. By using the App, you grant us a limited, non-exclusive licence to store and process your content solely for the purpose of providing and improving the App.

6.2 Data Storage. Your data is stored on servers provided by Supabase, Inc. Data may be stored and processed in data centres located in the European Union. We implement appropriate technical and organisational measures to protect your data, including Row Level Security (RLS) policies that ensure users can only access their own data.

6.3 Data Deletion. You may request deletion of your account and all associated data at any time through the App's Profile settings or by contacting us at contact@tryrebirth.com. Upon deletion, we will remove your personal data from our active systems within 30 days, subject to any legal retention requirements.

7. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose or in violation of any applicable laws; (b) attempt to reverse engineer, decompile, or disassemble the App; (c) interfere with or disrupt the integrity or performance of the App or its infrastructure; (d) attempt to gain unauthorised access to the App, its servers, or any associated databases; (e) use automated tools, bots, or scripts to access or interact with the App; (f) impersonate any person or entity, or misrepresent your affiliation with any person or entity; or (g) use the App in any manner that could damage, disable, or impair our servers or networks.

8. Health and Wellness Disclaimer

THE APP IS NOT A MEDICAL DEVICE, AND THE CONTENT IS NOT MEDICAL ADVICE. The challenges, tasks, and recommendations provided within the App are for general informational, educational, and motivational purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, sleep patterns, or lifestyle — particularly if you have any pre-existing medical conditions, mental health conditions, or are taking medication. Cold exposure, fasting, intense exercise, and other activities suggested by the App carry inherent risks. You assume full responsibility for your participation. We disclaim all liability for any adverse health outcomes resulting from your use of the App.

9. Intellectual Property

All content within the App — including but not limited to text, graphics, logos, icons, images, audio, the 3D momentum orb, animations, software code, UI/UX design, and the underlying technology — is the exclusive property of Wayfinity Ltd or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent. The "Rebirth" name and logo are trademarks of Wayfinity Ltd.

The App integrates with the following third-party services, each governed by their own terms and privacy policies:

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAYFINITY LTD AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CHANGES TO OR TERMINATION OF THE APP; (C) UNAUTHORISED ACCESS TO YOUR DATA; OR (D) ANY THIRD-PARTY CONDUCT ON THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) €50.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wayfinity Ltd and its directors, officers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the App.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App. If we make material changes that negatively affect your paid subscription, we will provide reasonable notice.

15. Termination

We may suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if we reasonably believe you have violated these Terms. Upon termination: (a) your licence to use the App ceases immediately; (b) you must delete all copies of the App from your devices; and (c) provisions of these Terms that by their nature should survive termination shall survive, including Sections 9, 11, 12, 13, and 17.

16. Dispute Resolution

16.1 Informal Resolution. Before initiating any formal proceedings, you agree to first contact us at contact@tryrebirth.com to attempt to resolve any dispute informally. We will endeavour to resolve disputes within 30 days of receiving notice.

16.2 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.

16.3 Jurisdiction. Any dispute arising from or relating to these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus. Notwithstanding the foregoing, we retain the right to seek injunctive or equitable relief in any court of competent jurisdiction.

17. General Provisions

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wayfinity Ltd regarding the App. Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction. Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control.
